IEBC Can Achieve 100% Credible October Elections & Accurate Tallying

The Independent Electoral Boundaries Commission (IEBC) created through Kenya Constitution Chapter Seven of “Representation of the People,” in improving on the August 8th 2017 electoral system can achieve a 100% credible October election and accurate tallying. IEBC can incorporate systems that have roles for religious leaders and media created as the IEBC eliminate electoral malpractices as required by Kenya Constitution law 86.

6am to 5pm - Voting 

Just like on August 8th 2017, IEBC open the stations, verify voter and give ballot to person. 

Person cast their vote. The process this time around should be faster since only one ballot will apply and only two candidates will be on the ballot. 

The IEBC require the representative of each candidate be present. The IEBC consider incorporating the Kenya, religious leaders as Independent observers where two religious leaders can observe in a polling station.     

IEBC system meet Kenya Constitution 86: At every election, the Independent Electoral and Boundaries Commission shall ensure that— (a) whatever voting method is used, the system is simple, accurate, verifiable, secure, accountable and transparent.

5pm onward – Tallying

The tallying done and form 34A written transforming the votes cast inside a box to a record 34A.  

Three persons sign the document. The 2 agents of the candidates and the presiding officer. 

The two local religious leaders as independent observers write an Independent report and submit to the IEBC audit office.   

34A Announcement and Transition of Announced Result Electronically 

Kenya Constitution law “86 At every election, the Independent Electoral and Boundaries Commission shall ensure that— (b) the votes cast are counted, tabulated and the results announced promptly by the presiding officer at each polling station.”

The law requires the announcement of results at each polling station. Once 34A generated, the presiding officer and the candidates' agents each take a picture of the 34A and send same via Whatsapp, Messenger or Email to the IEBC Chairman and Candidates. The IEBC Chairman further sends the 34A to Media houses.   

The IEBC through an announcement portal announce the 34A generated at a polling station in the National tallying center and in Media outlets. Within 60 seconds after signing 34A the document should be made public. 

The police officers provide security to the Presiding Officer who takes the original 34A to the returning officer.         

34As Manually Collated to Become 34B

Kenya Constitution 86. At every election, the Independent Electoral and Boundaries Commission shall ensure that— (c) the results from the polling stations are openly and accurately collated and promptly announced by the returning officer. 

The 34A original is taken to the Constituency returning officer for the establishment of the 34B. All Original 34A’s given by each polling station Presiding Officer to the Constituency Returning Officer.

The IEBC can have ask 3 religious leaders act as Independent Observers of the process and write report to submit to IEBC Audit office. 

Once 34B is generated the Candidates Agents and Returning officer take pictures and send to their respective parties and IEBC Chairman who start tallying based in 34Bs.

34Bs Manually Collated to Become 34C 

Each Constituency Returning officers take the 34B and 34As to IEBC Chairman who receives the original 34Bs and 34As and collates the 34Bs to create the 34C. The IEBC Chairman announces the official result of the Presidential election winner within the 7 day period as provided by law. 

Kenya Constitution 86 Law 

86. At every election, the Independent Electoral and Boundaries Commission shall ensure that— (a) whatever voting method is used, the system is simple, accurate, verifiable, secure, accountable and transparent; (b) the votes cast are counted, tabulated and the results announced promptly by the presiding officer at each polling station; (c) the results from the polling stations are openly and accurately collated and promptly announced by the returning officer; and (d) appropriate structures and mechanisms to eliminate electoral malpractice are put in place, including the safekeeping of election materials.

Kenya Constitution 86 Implementation to achieve 100% Credible Election and Tallied Results

The IEBC as an Independent Constitutional body through resolutions passed by the commissioners have the mandate to implement Kenya Constitution 86. 

The IEBC can incorporate religious leaders as observers; the IEBC can incorporate the use of phone camera picture ICT technology and transmission through: Whatsapp, Messages, Email and other ICT technologies; the IEBC can report and incorporate media organizations reporting of the announced 34A results as the 34As are generated and other systems that eliminate electoral malpractice.  

The two approaches: 34As announcement - provisional tallied results and the manual 34A - 34B - 34C will eliminate of electoral malpractices associated with 34As becoming 34Bs then 34C as Religious leaders play role of Trustees and the Media the role of announcements to all public. The transmission through diverse ICT platforms will further eliminate the discussion of one server system of transfer and eliminate discussions of hacking. 

At the end the provisional results tallied from 34As by the Media and IEBC and the Manual system should have identical results or within the margin of error of 1% based on human error mistakes of data entry.
